Terms and Conditions

By purchasing a ticket or visiting the event, you agree to the house rules and general terms and conditions of Challenge Events B.V. (Chamber of Commerce number: 96053798). These are set out below.

Article 1. Definitions
1.1. “Organization”: Challenge Events B.V., registered under Chamber of Commerce number 96053798, as well as the (legal) persons entrusted with organizing an Event on its behalf.
1.2. “Event”: any activity organized by the Organization, including (but not limited to) music parties, catering, festivals, parades, and festival campsites, all in the broadest sense of the word.
1.3. “Visitor”: any (legal) person who has validly purchased or received a ticket for an Event organized by the Organization, and any person who wishes to gain access to an Event with a valid ticket.
1.4. “Site”: all buildings, (covered or uncovered) spaces, fields, squares, etc., that are part of the area where the Event takes place, including parking spaces and approach routes.
1.5. “Ticket of entry” or “Tickets of entry”: a (digital) document provided by or on behalf of the Organization, or a barcode provided by or on behalf of the Organization, with which the Visitor can gain access to a specifically designated Event.

Article 2. Applicability
2.1. These general terms and conditions apply to—and form an integral part of—every offer and every agreement relating to services or products of any nature to be provided by the Organization, unless expressly agreed otherwise in writing.
2.2. These general terms and conditions also apply to agreements concluded with or via (or through the mediation of) official (pre-)sales addresses designated by the Organization for that purpose.
2.3. These general terms and conditions also apply during the Event and to all (further) agreements that the Visitor concludes with the Organization (such as purchasing tokens, drinks, food, and merchandise).
2.4. These general terms and conditions can also be consulted (and saved) via the Event’s website and are available for inspection at the entrance of the Event.
2.5. House rules may apply to an Event. The house rules can be consulted via the website of the relevant Event and the Organization and are available for inspection at the entrance of the Event. The Visitor hereby explicitly declares that they agree to the relevant house rules and also declares that they will behave in accordance with those house rules.
2.6. Obvious clerical errors or mistakes in the Organization’s offers release it from the obligation to fulfill and/or from any obligation to pay compensation arising from such errors, even after an agreement has been concluded.
2.7. If a Visitor also orders a Ticket (or multiple Tickets) for third parties, he/she declares to be authorized to accept these general terms and conditions on behalf of those third parties and to inform those third parties about the applicability of these general terms and conditions.

Article 3. Ticketing
3.1. The agreement between the Organization and the Visitor is concluded at the moment the Visitor orders/purchases one or more Tickets for an Event from the Organization or from an official (advance) sales address designated by the Organization for this purpose, or by presenting a ticket to gain access to the Event.
3.2. The Organization will provide the Visitor with the Ticket or Tickets for the relevant Event once, in a manner to be determined by the Organization (e.g., by e-mail).
3.3. A provided Ticket entitles one person to access the Event once.
3.4. Only the holder of the Ticket who first presents the Ticket at the Event will be granted access to the Event. The Organization is not obliged (but is authorized) to carry out further checks on whether the person holding the Ticket is also the rightful owner.
3.5. The Visitor must ensure that they become and remain the holder of the Ticket issued by the Organization or a (pre-)sales address engaged by the Organization. From the moment the Ticket is made available to the Visitor, the Visitor bears the risk of loss, theft, damage, or misuse of the Ticket.

Article 4. Prohibition of resale
4.1. The Visitor is not permitted to (re)sell, offer for sale, and/or provide Tickets for an Event to third parties for or in the context of commercial purposes without the explicit written permission of the Organization. “Commercial purposes” is understood to mean any sale where the seller receives a higher amount for the tickets than the price set by the Organization. If this prohibition is violated, the Organization is authorized to declare a Ticket invalid, without being obliged to refund any amount paid.
4.2. Under no circumstances is it permitted to distribute or raffle Tickets for online and/or offline lotteries and/or promotional campaigns without written permission from the Organization.
4.3. In the event of a violation of this article, the Organization is entitled to refuse the purchaser of the Ticket(s) as referred to in the previous paragraph access to the Event, and to recover all resulting damages from the Visitor.

Article 5. Access to the Event
5.1. Only an original, valid, and undamaged Ticket grants access to the Event.
5.2. The Organization may decide to provide Visitors with an item (such as a wristband) to easily see whether—and to which areas—the Visitor has access, hereinafter referred to as an “ID means.” The Visitor explicitly declares that they will cooperate with this. The Visitor must keep the ID means on them at all times during the Event and on the Site in the indicated manner, and may not break any seal. If the seal is broken and/or lost, the ID means loses its validity and the Visitor can be removed from the Site and denied further access.
5.3. When visiting the Site, the Visitor shall strictly follow the instructions of the Organization’s staff and the instructions of the police, fire brigade, health authorities (GGD), or other competent authorities present.
5.4. The Visitor may be searched at or before entering the Site, on the Site, and also during the Event. The Visitor expressly agrees to a possible search. If the Visitor does not cooperate, they will be denied access to the Site.
5.5. To gain access to the Event and/or the Site, the Visitor must have valid proof of identity (passport, identity card, or driver’s license), to be shown upon request.
5.6. The minimum age for entry to the Event is 18 years unless otherwise stated.
5.7. Access to the Event is possible from opening time to closing time, as indicated on the Ticket and/or on the Event website. The closing time is not necessarily the end time of the Event.
5.8. Partly for safety reasons, leaving the Site temporarily after arrival is not permitted, unless the Organization explicitly agrees otherwise.
5.9. The following are not permitted on the Site, unless otherwise stated in the relevant Event’s house rules: • Food & drinks brought from outside; • Brought-in food supplements & proteins (protein); • Glassware, sharp objects, umbrellas, (fire)arms, laser pointers, narcotics (drugs); • Vehicles (cars, trailers, caravans, motorhomes, bicycles), construction tents; • Pets; • Liquids, such as (aerosols containing) deodorant, lighter gas, perfume; • Sound systems, generators/aggregates, BBQs, stoves, refrigerators, draught installations; • Large objects (such as sofas), confetti/party poppers; • Clothing with discriminatory (e.g. nationalistic and/or racist), offensive and/or threatening signs or expressions, as well as clothing with club or team logos (e.g. football shirts); • Professional photography, film, and other recording equipment.
5.10. It is only permitted to bring medication to the Event if: • The medication is still in its original and sealed packaging; and • Accompanied by the original package leaflet; and • It can be demonstrated why this medication is used.
If the aforementioned conditions are not met—or if the Organization has other grounds to doubt the medications—then the Organization is authorized to confiscate the medication, without being obliged to reimburse (the value of) it, and dispose of it in the appropriate container.
5.11. The Organization may seize (or have seized) objects referred to in Article 5.9. Legal items that are also valuable can be retrieved after payment of a fee to be determined by the Organization, after the Event. Illegal items will be handed over to the police. If illegal items are found, the Organization may refuse the Visitor access to the Event.
5.12. The Organization follows the legal guidelines set by the government regarding COVID-19. If a Visitor does not cooperate or does not wish to comply, access may be refused.

Article 7. Other provisions
7.1. Toilet facilities are available on the Site, possibly free of charge unless stated otherwise. The Visitor is obliged to use these facilities. Defecating or urinating in places other than the toilet facilities is strictly prohibited.
7.2. Smoking is prohibited in all indoor/covered locations on the Site, including e-cigarettes.
7.3. Throwing drinks or objects is prohibited.
7.4. It is prohibited to take away any property belonging to the Organization. Removing the Organization’s property is considered theft and will be reported to the police.
7.5. The Visitor is prohibited from behaving in such a way that order at the Event is disturbed.
7.6. In the event of destruction of property belonging to the Organization or to third parties on or around the Site, a police report will be filed.
7.7. It is prohibited to sell goods on or around the Site before, during, or after an Event without explicit written permission from the Organization.
7.8. It is prohibited to advertise in the broadest sense of the word before, during, or after an Event on or around the Site without explicit written permission from the Organization. This prohibition includes advertising other events or businesses. Any form of advertising (such as distributing flyers or stickers, putting up posters, or addressing Visitors) is not allowed. A minimum fine of €1,000 will be imposed on Visitors (and/or persons) who act in violation of these provisions or who instruct others to do so, as well as on the organization of any event being advertised.
7.9. Visitors who are under the age of 18 are not allowed to buy, carry, drink, or attempt to obtain alcoholic beverages. The Organization reserves the right to remove any Visitor acting in violation of this article from the Site, without any obligation to refund the entry fee.
7.10. Regardless of age, the Visitor is not permitted to provide alcoholic beverages (whether or not in return for payment) to anyone under the age of 18. The Organization reserves the right to remove any Visitor acting in violation of this article from the Site, without any obligation to refund the entry fee.

Article 8. Media and media equipment
8.1. During the Event, photo and film recordings may be made on behalf of (or with accreditation from) the Organization. The Visitor expressly agrees that image and/or sound recordings of visitors (and therefore possibly of the Visitor) at the Event may be made on and around the Site and that these recordings may be distributed or exploited through all possible media channels.
8.2. During the Event, the Visitor is allowed to bring and use photographic equipment intended for consumers on the Site. “Photographic equipment intended for consumers” includes digital compact cameras (with a standard, fixed lens), mobile phones with a camera, and disposable devices. It is not allowed to bring professional photography equipment or accessories (such as a (telescopic) tripod, which also includes a GoPro Telescoping Pole). It is also not permitted to bring a film camera. Whether or not the equipment referred to in this article is prohibited is at the sole discretion of the Organization. If you are unsure whether your camera equipment is allowed, please contact the Organization by email prior to the Event.
8.3. If a Visitor is found using the unauthorized equipment referred to in Article 8.2 on the Site, the Organization is authorized to:a) Temporarily confiscate the equipment until (at the Organization’s discretion): 1. The Event has ended; or 2. The Visitor has shown that all recordings and any copies thereof have been deleted; or 3. A time to be determined, if the Organization has reasonable grounds to do so;b) Remove a Visitor acting in violation of Article 8.2 from the Site without being obliged to refund the entrance fee.
8.4. Professional (press) photographers and/or persons wishing to make photo or film recordings of an Event for commercial reasons must be in possession of valid accreditation from the Organization.
8.5. Reprinting and/or copying of the program (booklet), posters, other printed materials, and/or digital expressions of the Organization or the Event is prohibited without the express prior written consent of the Organization.
8.6. The Organization is authorized to check compliance with the above articles and is also authorized to confiscate and/or destroy recordings.

Article 9. Force majeure
9.1. In the case of force majeure, the Organization has the right to cancel the Event or to organize it on another date.
9.2. The term “force majeure” as referred to in this article also includes all unforeseen circumstances that have arisen through no fault of the Organization, such as illness or withdrawal of an artist, program changes, or other force majeure situations (e.g., weather conditions, epidemics, strikes, global health issues, terrorist threats, etc.).
9.3. If the Event is canceled as a result of or in connection with a force majeure situation, the Organization will reimburse the purchase amount (excluding fees) of the Admission Ticket. The Visitor cannot claim any (damage) compensation from the Organization other than the refund of the purchase amount. Refunds will only be made after the Visitor has submitted an original, valid, and undamaged Admission Ticket to the Organization.
9.4. Contrary to Article 9.3, the Organization is not obliged to refund Tickets in situations such as cancellation due to an artist’s illness or withdrawal, program changes, or other force majeure situations (e.g., weather conditions, epidemics, strikes, global health issues, terrorist threats, etc.).
9.5. No refunds can be made as long as the Event takes place.

Article 10. Liability
10.1. If the Visitor is a consumer: The Organization’s liability is limited to compensation for direct damages, and the total amount payable to the Visitor will never exceed the amount paid out by the Organization’s insurer in the relevant case. The Organization is never liable for indirect damages, including consequential damage, lost profit, lost savings, or damage due to business interruption.
10.2. If the Visitor is a (legal) person acting in the course of a profession or business: The Organization is only liable for damage suffered by the Visitor if and insofar as this damage is a direct result of intent or deliberate recklessness on the part of the Organization’s management. In such a case, liability is limited to direct damages up to a maximum of the amount paid out by the Organization’s insurer in the relevant case.
10.3. Entering the Site and visiting the Event is entirely at your own risk. Lockers may be available on the Site for storing valuables (whether or not for a fee), unless otherwise indicated. Using a locker is entirely at your own risk. The Organization is not liable for damage to, loss of, or theft of the Visitor’s belongings.
10.4. The Visitor acknowledges that loud music may be played during the Event. The Visitor is responsible for taking any necessary hearing protection measures. The Organization advises the Visitor to give their hearing occasional rest by moving to an area with no or lower-volume music and to wear hearing protection at all times.
10.5. Changes or deviations in the program after purchasing the Admission Ticket do not entitle the Visitor to cancel the purchase (e.g., through termination or nullification), nor to a (partial) refund of the purchase amount.
10.6. The Organization is not responsible for the manner in which artists/acts perform their part in the Event.

Article 11. Dissolution
11.1. The Organization always reserves the right to dissolve the agreement with the Visitor in whole or in part. Dissolution in this case means that the order for Tickets is canceled. Purchased tickets become invalid immediately. When an order is canceled, the full purchase amount (excluding any fees paid by the Visitor) will be refunded. The Visitor cannot claim any (damage) compensation other than a refund of the purchase amount. If an order is canceled after the Visitor has received an Admission Ticket, the purchase amount will only be refunded after the Visitor has returned an original, valid, and undamaged Admission Ticket to the Organization. This article does not apply where Article 9 applies.
11.2. If the Visitor acts in violation of the agreement (including these general terms and conditions), they may, among other measures, be removed from the Site and denied further access. In addition, the Visitor is liable for all damages arising from their actions. The amount to be reimbursed by the Visitor to the Organization is at least €150.00, even if the Organization’s actual damage is lower.

Article 12. Personal data
12.1. The Organization processes the personal data of Visitors and of visitors to its websites in accordance with the Dutch Personal Data Protection Act (and subsequent applicable privacy legislation, such as the GDPR).

Article 13. Final provisions
13.1. Only Dutch law applies to these general terms and conditions.
13.2. These general terms and conditions have been drawn up in Dutch and translated into English. In the event of any inconsistency between the Dutch version and the English translation, the Dutch version shall be binding.
13.3. The District Court of Breda has exclusive jurisdiction over any disputes that directly or indirectly relate to any agreement or legal act to which these general terms and conditions apply.
13.4. Insofar as the court designated in these terms and conditions does not have relative jurisdiction in the event of an agreement with a Visitor who is a consumer, the Visitor has the right—within one month after the Organization has invoked this article in writing—to opt for dispute resolution by the competent court according to the law.
